END-USER LICENSE AGREEMENT
BY ACCEPTING, YOU (THE ORIGINAL PURCHASER) INDICATE YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT WISH TO ACCEPT THE PRODUCT UNDER THESE TERMS YOU MAY CHOOSE NOT TO ACCEPT BY SELECTING "I do not accept ..." AND NOT INSTALLING THE SOFTWARE.
Use of the Software is subject to the following terms and conditions. If you do not accept these terms, you must cease use of the Software. Continued use of the Software indicates acceptance of these terms.
Ownership of the Software
1. The Software ("the Software") and the accompanying files are owned by Cybernescence Limited ("the Company") and are protected by United Kingdom copyright laws, by laws of other nations, and by international treaties.
Every effort has been made to make this software as complete and as error free as possible, but no warranty of fitness is implied.
2. The Software is provided "as is". The Company disclaims all warranties, either express, statutory or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The entire risk for the use of the Software is assumed by the user. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE OR ITS FUNCTIONS WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY DEFECTS WILL BE CORRECTED. 3. The Company does not assume liability for damages, including loss of profit, lost savings, damage to equipment or data, or other incidental or consequential damages arising out of the use or inability to use the Software, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 4. The Company's entire liability and your exclusive remedy shall be return of the price paid for the Software. 5. This Limited Warranty is void if failure of the Software has resulted from modification, accident, abuse, or misapplication.
Restrictions on Use
The ORIGINAL PURCHASER is granted a LICENSE to use the software only, subject to the following restrictions and limitations.
6. The Company grants the right for a single user to use the Software on a single machine. You may install the Software on more than one computer provided that you have purchased sufficient licenses. Network installation is also only permitted if you have purchased licenses sufficient to cover the number of copies concurrently in use. You may make backup copies of the Software for your personal use only. 7. You may not reverse engineer, decompile, or disassemble the Software. You may not modify the Software in any manner. 8. You may permanently transfer the Software if you retain no copies and the transferee agrees to be bound by the terms of this Agreement. Such a transfer terminates your license. You may not rent or lease the Software or otherwise transfer or assign the right to use the Software, except as stated in this paragraph. 9. You may not copy the Software, except that you may make a copy of the Software solely for backup or archival purposes, and except as stated in the next paragraph. 10. The trial version of the Software may be freely distributed under the conditions that it is not modified in any way and that no remuneration, monetary or otherwise, is received for the trial version. For more information concerning distribution of the trial version of the Software, see the Distribution Agreement.
11. The Company provides free technical support by email to users of the Software. However, the Company reserves the right to terminate technical support at any time for any reason. 12. The Company reserves all rights not specifically granted in this license. 13. This Agreement is governed by the laws of England & Wales, United Kingdom. 14. Notice to U.S. Government End Users. The Software and Documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §§227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States. 15. THIS PRODUCT MAY INCORPORATE IMPLEMENTATIONS OF CRYPTOGRAPHIC ALGORITHMS THAT ARE REGULATED (E.G. PLEASE NOTE - After purchase the software REQUIRES INTERNET ACCESS ONCE for LICENSE ACTIVATION. The software may then make occasional online checks of the validity of the license if internet connectivity is available. If you do not want the software to access the Internet then DO NOT INSTALL.
We do have phone lines listed on our contact page, but we disclose upfront that support via phone is not provided. Phone support is often great to have, especially for services bases organisations. However we've found that phone support isn't sclabale nor efficient for a small web-based software business like ours.
Any technical issues usually involve troubleshooting and investigation which may take a little time and love with our creations. Rest assured we'll get back to you as fast as we can by email - make sure to check your 'spam' email folders for our reply if obe doesn't arrive soon.
